General conditions of sale

We invite you to read the General Terms and Conditions of Sale applicable to all orders placed on our website.


Article 1: Scope of application
The general terms and conditions of sale apply exclusively to current and future business relationships existing between Betjeman and Barton, 23 bd Malesherbes 75008 Paris, France ("we") and the person placing the order ("you").
We may modify these terms and conditions of sale at any time, provided that we publish these modifications on our website.

Article 2: Order
We undertake to accept your order in accordance with these general terms and conditions of sale.
When you place your order, we inform you of the availability of the products you wish to purchase. However, if, despite our best efforts, the products become temporarily unavailable (out of stock, being reprinted, etc.) after you place your order, we will inform you by email and invite you to cancel or modify your order. If the products become permanently unavailable (out of stock, etc.) after you place your order, we will automatically cancel your order and inform you by email before refunding any amounts paid for the missing products.
By confirming your order, you accept all of these terms and conditions of sale, which are available on the website, and acknowledge that you have read and understood them fully. You therefore waive the right to rely on any conflicting document, including your own general terms and conditions of purchase, as placing an order constitutes acceptance of these terms and conditions of sale. This confirmation, along with all the data we have recorded, will serve as proof of our transactions.

Article 3: Price
The prices shown in euros are inclusive of all taxes, calculated according to French tax law, but excluding shipping costs. We reserve the right to change our prices at any time. We are committed to applying the prices in effect at the time of your order.
For orders outside the European Union, prices will be adjusted to include VAT when you enter your delivery address in the appropriate form. Any applicable customs duties may be added to the total shipping costs. Under no circumstances will we be liable for any additional costs related to the delivery of the order beyond the shipping charges described and invoiced when the order is placed on our website.

Article 4: Payment
Payment is due immediately upon ordering. Cards issued by banks located outside of France must be international bank cards. Secure online payment by bank card is completely safe: it uses the SSL (Secure Socket Layer) protocol. The information transmitted is encrypted by software and cannot be read during transmission over the network.

We have chosen Lyra's Sogecommerce online payment solution for Société Générale. Your order can only be processed once your payment has been accepted and this acceptance has been transmitted to our services by CCF.

It is also possible to pay by bank transfer, check or credit card with Paypal.

Article 5: Delivery
Unless otherwise specified, delivery will be made to the address you provided when placing your order. Risk of loss or damage to the goods passes to you upon delivery. In case of non-receipt of the package, you have 3 weeks to make a claim.

Article 6: Returns and refunds
We guarantee the quality and good condition of all items we ship. We cannot be held responsible for any damage to the order caused by transport or delivery.
However, in accordance with Articles L.221-18 et seq. of the French Consumer Code, you have fourteen (14) business days from the date of delivery of your order to return any item that does not suit you and request an exchange or refund without penalty. In all cases, the return shipping costs remain your responsibility.


Article 7: Retention of Title
The delivered goods will remain our property until you have fulfilled all your obligations to us, and in particular until full payment of the price, including any applicable interest. This retention of title does not preclude the transfer of risk, which will pass to you from the date the ordered products leave our premises in accordance with the provisions of Article 5.

Article 8: Warranty against hidden defects and liability
If the products we delivered to you have a hidden defect, we may, at our discretion, either remedy the defect or replace the defective product. If we do not wish to remedy the defect or replace the defective product, or if we are unable to do so, or if we cannot do so within a reasonable timeframe due to circumstances beyond our control, you may, at your option, return the product to us for a full refund of the purchase price and return shipping costs, or request a price reduction.
The products offered comply with current French legislation.
We are committed to exercising all due care, in accordance with professional standards, in the provision of the service offered to the client. However, we cannot be held liable for any failure to fulfill our contractual obligations due to unforeseen circumstances or force majeure, including but not limited to natural disasters, strikes, fires, floods, equipment failure or breakdown, disruptions to transportation or communication, or actions on your part.
Furthermore, we will not be held liable for any delay due to stock shortages or for any errors in the presentation of products on our website, as the photographs, texts and illustrations representing the products are not contractual.

Article 9: Protection of personal data
We are committed to protecting your personal data. By agreeing to these terms and conditions, you acknowledge that you have read our privacy policy and consent to our collection and use of this data.

Article 10: Applicable Law and Jurisdiction
These terms and conditions of sale are governed by French law and the Vienna Convention on Contracts for the International Sale of Goods, excluding the United Nations Convention on Contracts for the International Sale of Goods. All disputes relating to the business relationship between you and us shall be subject to the exclusive jurisdiction of the French courts.
